The winner will receive a
modeling contract with Rockstar Clothing and he/she will be
featured on the cover of our next Catalogue, website and other
promotional material. By
clicking accept, you agree that you are either 18 years of age, or
that you have parental consent to enter this contest.
Underworld Distributing is the sole owner of Rockstar Clothing and
this Model Search Contest.
You must agree to these Terms and Conditions before you can enter
Rockstar Clothing's Model Search Contest. By clicking accept, you
are agreeing to the Terms and Conditions posted on this site, you
agree to be legally bound and subject to them. If you do not agree
to the Terms and Conditions, you will not be eligible to
participate in the Model Search Contest.
Users that violate the Terms and Conditions may have their entries
disqualified without warning. Underworld Distributing can not be
held liable for any loss of data due to technical problems or
human error that may arise during the contest.
Underworld Distributing is committed to promoting artistic
expression while maintaining standards consistent with the
community. Accordingly, no entry may contain, process, digitize,
post, upload, store, share or otherwise display any of the
following on any sites affiliated with the contest:
a. Content or material that we believe is pornographic, obscene,
or of an adult or sexual nature;
b. Content or material that we believe is grossly offensive to the
online community, including but not limited to, blatant
expressions of bigotry, prejudice, racism, hatred and profanity;
c. Content or material that exploits children under the age of 18
or posts or discloses any personally identifying information about
children under the age of 18;
d. Content or material promoting or providing instructional
information about illegal activities, promoting harm or injury to
any group, individual or cruelty to animals including, but not
limited to, disseminating personal information about another
individual for malevolent purposes, including libel, slander,
defamation or violation of an individual’s right to privacy.
e. Copyrighted content or material that is used without the
express permission of the owner; Photographs and other images
published in books, magazines, posters, calendars, websites and
other media are generally protected by copyright law. Uploading
these images to the contest sites without the owner's permission
constitutes copyright infringement and may result in termination
of your contest entry.
f. Content or material that infringes or encroaches on the rights
of others, including, but not limited to, infringement of privacy
and publicity rights and harm to reputation; or
g. Any links to the above.
Underworld Distributing has the sole discretion to decide whether
content or material is prohibited on the Site. You acknowledge
that Underworld Distributing has the absolute right (but not the
obligation) to delete, move and edit content and material for any
reason, in any manner, at any time, without notice.
You, and NOT Underworld Distributing, are solely responsible and
liable for all content posted and stored in the contest Sites. You
should also know that in visiting the contest sites, you may be
exposed to materials you consider to be offensive and you assume
responsibility for your exposure.
When you enter the Rockstar Clothing Model Search Contest, you
understand that your photographs will be viewed and made available
to others in the contest Sites and we may incorporate them into
advertising or other uses.
As a condition of entry, you agree that all submissions become the
sole property of Underworld Distributing.
All of the material on the web sites affiliated with Underworld
Distributing is protected by the copyright laws of the U. S. and
other countries, both as individual works and as a collection. You
are only allowed to use these materials as indicated on the
competition sites; other uses are prohibited by copyright laws.
If you believe that your material or the material of another has
been wrongfully copied, send an email to mail@underworlddistributing.com.
In order for Underworld Distributing to investigate and address
your complaint, please provide Underworld Distributing with all
relevant information including how to best contact you.
Underworld Distributing will never release your name or other
personal information without your permission unless required by
law. Underworld Distributing may use aggregated member information
that does not identify any individual member. Underworld
Distributing makes every effort to maintain the security of the
storage of private information, but you acknowledge that
Underworld Distributing shall not be liable in the event its
security measures are breached.
Underworld Distributing will not send unsolicited email. All
emails, including newsletters and announcements, will contain
information on how to unsubscribe from that email list. In the
event that you receive an email that you think is unsolicited,
please follow the instructions contained in the email for letting
us know, and Underworld Distributing will make every effort to
have your email address removed from future mailings.
Underworld Distributing urges all members to maintain backup
versions of their data and materials to guard against losses of
any kind. Underworld Distributing is not responsible for any loss
of data and/or files, nor is it required to return any data,
resulting from Underworld Distributing's suspension or deletion of
data and/or files, network or system outages, file corruption or
for any other reason.
There is no purchase necessary to enter or to win, nor is there
any cost to enter. The Contestant is deemed to be the holder of
the established email account associated with the entry.
The Contestant submitting the entry must be 16 to 30 years of age.
Any contestant under the age of 18 will be required to have a
parent or legal guardian of the child accept the terms of this
agreement. If the winner of the contest is under 18 years of age,
parental consent will be required before the award of a prize by
Underworld Distributing. Underworld Distributing holds the right
to ask for legal identification before the prize is awarded to any
such person.
By submitting the entry, Contestant is warranting that the
Contestant owns the photograph and that it is original,
non-professional, neither previously published nor having won any
other award whatsoever. By submitting the entry, Contestant is
granting to Underworld Distributing the right to use the
photograph for commercial purposes for an unlimited time.
By submitting the entry, Contestant agrees and hereby releases
Underworld Distributing and its parent companies, affiliates,
subsidiaries, employees, agents, officers and directors from any
and all liability or responsibility arising in connection with
Contestant’s participation in the contest or as to any prize(s)
which may be awarded. Underworld Distributing reserves the right
at its sole discretion to reject and disqualify any nude
photograph or those photographs which are deemed in its sole
discretion to be obscene, profane, offensive, lewd, pornographic
or otherwise inappropriate. Underworld Distributing assumes no
responsibility for entries unable to be processed for any
technical reason and further reserves the right to cancel the
contest if it becomes technically corrupted or because of
unauthorized human intervention. Underworld Distributing reserves
the right in the event of such cancellation to award the prize to
an eligible, non-suspect entry received prior to cancellation.
Contestant agrees that entry and acceptance of prize constitutes
permission for Underworld Distributing to have the option of using
the name, hometown, likeness, photograph, voice and statements of
the Contestant. Such use will be without compensation and may be
for editorial, public relations, promotional or advertising
purposes, or any other purpose as deemed reasonable by Underworld
Distributing. Documentation of such permission may be requested by
Underworld Distributing, and failure to provide such documentation
will result in forfeiture of any winner status and/or prize.
This contest is limited to US Residents only, and Contestants must
have a shipping address in the United States. This contest is void
where prohibited by law. Applicable taxes are the responsibility
of the Contestant, and appropriate tax identification information
may be required prior to the awarding of any prize.
Contestants, supporters of the contest, and other such persons will
be afforded the opportunity to participate in the contest voting
system that will be set up through the contest sites. However,
Underworld Distributing holds the sole right to award the prize to
any entrant of their choice upon completion of the contest.
Employees of Underworld Distributing, and its affiliates, parent
companies and subsidiary companies, and their immediate families
(parents and children) are not eligible to participate in the
contest.
This contest is sponsored and promoted by Underworld Distributing,
the parent company of Rockstar Clothing.
The winning selection will be posted online after the close of the
voting period. Winners will also be notified via email.
Any Contestant who does not agree with the above terms and
conditions should not enter this contest.
RULES AND REQUIREMENTS:
Requirements:
1. In order to participate in the contest, contestants must be the
valid holder of a Myspace Profile. The contest will be conducted
through www.underworlddistributing.com and Rockstar Clothing's
Official Myspace Page. Any other methods of entry will not be
accepted.
2. Contestants must be between the age of 16 and 30 years of ages.
3. Contestant must accept these terms and conditions in order to
enter this contest. If Contestant is under the age of 18, a parent
of legal guardian of the Contestant must accept these terms and
conditions in order to enter the contest.
4. All contestants will be
responsible for their own transportation to and from any photo
shoots or events that are affiliated with this model search
contest.
Voting System:
1. Contestants will be afforded the right to vote for themselves.
2. Votes may be placed once a day by any person that is the valid
holder of a Myspace Profile.
3. Each vote placed will be counted as one point for that
Contestant.
Winner's will be chosen as follows:
1. The winner of the Rockstar Clothing Model Search, beginning on
this 30th day of July 2007, and ending on November 3rd, 2007, will be chosen
based on the most number of votes for that Contestant. Underworld
Distributing has the sole right to award the prize to any entrant
that they deem fit for the contest. All winners will be notified
via e-mail. Winner's must fully accept any terms and agreements
that will be presented to them before award of a prize. Finalists
must be present at the November 3, 2007 Battle of the Bands /
Battle of the Models in order to win. All contestants are
responsible for transportation to photo shoots and other events in
affiliation with this model search contest.
Winner's will be awarded their prize as follows:
Grand Prize:
1. The Grand Prize winner will be eligible participate in a photo
shoot for Rockstar Clothing conducted by Underworld Distributing.
2. The Grand Prize winner will be eligible to appear on the cover
of Underworld Distributing's next catalogue.
3. The Grand Prize winner will be eligible to be the featured
model on Underworld Distributing's website as well as other
affiliated sites (Rockstar Clothing, Kila Clothing, and Dark Tower
Apparel).
4. The Grand Prize winner will receive $250.00 worth of cash and
prizes from Underworld Distributing.
Runner Up:
1. The runner up will be eligible to participate in a photo shoot
for Rockstar Clothing conducted by Underworld Distributing.
2. The runner up will be eligible to appear on the cover of
Underworld Distributing's next Catalogue.
3. The runner up will be eligible to be the featured model on
Underworld Distributing's website as well as other affiliated
sites (Rockstar Clothing, Kila Clothing, Dark Tower Apparel).
4. The runner up will receive $125.00 worth of cash and prizes
from Underworld Distributing.
By entering into the Rockstar Clothing Model Search Contest, You
Agree To Indemnify Underworld Distributing for Any Claims
Resulting From Your Violation of These Terms and Conditions.
YOU AGREE TO INDEMNIFY AND HOLD Underworld Distributing, ITS
PARENTS, SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, CO-BRANDERS,
LICENSORS AND ANY OTHER PARTNERS AND EMPLOYEES HARMLESS FROM ANY
AND ALL LOSSES, EXPENSES, DAMAGES OR COSTS, INCLUDING REASONABLE
ATTORNEYS’ FEES, RESULTING FROM ANY VIOLATION OF THESE TERMS AND
CONDITIONS, YOUR USE OF THE contest sites, AND THE CONDUCT OF
ANOTHER ACCESSING THE CONTEST SITES WITH YOUR USER NAME AND
PASSWORD.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT UNDERWORLD DISTRIBUTING
WILL HAVE NO LIABILITY FOR SPECIAL, INCIDENTAL, INDIRECT OR
CONSEQUENTIAL DAMAGES OF ANY KIND IN CONNECTION WITH YOUR USE OF
THE CONTEST SITES, EVEN IF YOU HAVE BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES.
This Agreement will be governed and construed in accordance with
the laws of the State of Nevada, without regard to its conflict of
laws provisions. By using the contest sites you agree to personal
jurisdiction of the state and federal courts of the State of
Nevada.
You agree that Underworld Distributing reserves the right to amend
these Terms and Conditions at any time, for any reason, and
without notice, including the right to terminate the contest.
These Terms and Conditions are the entire agreement between you
and Underworld Distributing and govern your use of the contest
sites and services. This agreement supersedes any prior agreements
between you and Underworld Distributing. The failure of Underworld
Distributing to enforce any right or provision of this agreement
does not constitute a waiver of the right or provision. If any
portion of this agreement is deemed to be invalid, the other
portions of the agreement will remain in full force and effect.
