Battle of the Bands 2007!
Underworld Distributing is the sole owner of Rockstar Clothing and
this Battle of the Bands.
You must agree to these Terms and Conditions before you can enter
Rockstar Clothing's Battle of the Bands 2007. By accepting these
terms and conditions you agree to be legally bound by them and be
subject to all rules stated in this agreement. If you do not agree
to the Terms and Conditions, you will not be eligible to
participate in the Battle of the Bands.Users that violate the
Terms and Conditions may have their entries disqualified without
warning.
Underworld Distributing is committed to promoting artistic
expression while maintaining standards consistent with the
community. Accordingly, we highly discourage the use of profanity
in any material including lyrics, merchandise, and performances.
Excessive profanity may result in immediate disqualification from
the contest. Please remember that this will be an all ages show,
and that content should be kept clean in order to accomodate for
younger age groups attending the show. Underworld Distributing
holds the sole right to disqualify any band who they feel are not
meeting the standards of this agreement. In addition, we
discourage the use of the following in any part of your
performance:
a. Content or material that we believe is pornographic, obscene,
or of an adult or sexual nature;
b. Content or material that we believe is grossly offensive to the
community, including but not limited to, blatant expressions of
bigotry, prejudice, racism, hatred and profanity;
c. Content or material that exploits children under the age of 18
or posts or discloses any personally identifying information about
children under the age of 18;
d. Content or material promoting or providing instructional
information about illegal activities, promoting harm or injury to
any group, individual or cruelty to animals including, but not
limited to, disseminating personal information about another
individual for malevolent purposes, including libel, slander,
defamation or violation of an individual’s right to privacy.
e. Bands are solely responsible for obtaining the legal rights to
perform copyrighted materials and are liable for any and all
royalty costs associated with copyrighted material.
f. Content or material that infringes or encroaches on the rights
of others, including, but not limited to, infringement of privacy
and publicity rights and harm to reputation; or
g. Any links to the above.
Underworld Distributing has the sole discretion to decide whether
content or material is prohibited in this Battle of the Bands. You
acknowledge that Underworld Distributing has the absolute right
(but not the obligation) to disqualify any band for any reason, in
any manner, at any time, without notice.
You, and NOT Underworld Distributing, are solely responsible and
liable for all content used in your performance. Bands are solely
responsible for any actions that may result from their performance
into this Battle of the Bands. Underworld Distributing and The
Warehouse are not in any way responsible for any equipment that
may be lost, stolen, or damaged during the Battle of the Bands.
When you enter the Rockstar Clothing Battle of the Bands, you
understand that your band will be used in promotions, and band
information may be made available to the public on Rockstar
Clothing web Sites and other forms of media. Any photos released
may also be used for promotional purposes.
As a condition of entry, you agree that all submissions become the
sole property of Underworld Distributing.
All of the material on the web sites affiliated with Underworld
Distributing is protected by the copyright laws of the U. S. and
other countries, both as individual works and as a collection. You
are only allowed to use these materials as indicated on the
competition sites; other uses are prohibited by copyright laws.
If you believe that your material or the material of another has
been wrongfully copied, send an email to mail@underworlddistributing.com.
In order for Underworld Distributing to investigate and address
your complaint, please provide Underworld Distributing with all
relevant information including how to best contact you.
Underworld Distributing will never release your name or other
personal information without your permission unless required by
law. Underworld Distributing may use aggregated member information
that does not identify any individual member. Underworld
Distributing makes every effort to maintain the security of the
storage of private information, but you acknowledge that
Underworld Distributing shall not be liable in the event its
security measures are breached.
Underworld Distributing will not send unsolicited email. All
emails, including newsletters and announcements, will contain
information on how to unsubscribe from that email list. In the
event that you receive an email that you think is unsolicited,
please follow the instructions contained in the email for letting
us know, and Underworld Distributing will make every effort to
have your email address removed from future mailings.
The Contestant submitting the entry must be 16 to 30 years of age.
Any contestant under the age of 18 will be required to have a
parent or legal guardian of the child accept the terms of this
agreement. If the winner of the contest is under 18 years of age,
parental consent will be required before the award of a prize by
Underworld Distributing. Underworld Distributing holds the right
to ask for legal identification before the prize is awarded to any
such person.
By submitting the entry, Contestant agrees and hereby releases
Underworld Distributing and its parent companies, affiliates,
subsidiaries, employees, agents, officers and directors from any
and all liability or responsibility arising in connection with
Contestant’s participation in the contest or as to any prize(s)
which may be awarded. Underrworld Distributing assumes no
responsibility for entries unable to be processed for any
technical reason and further reserves the right to cancel the
contest if it becomes technically corrupted or because of
unauthorized human intervention. Underworld Distributing reserves
the right in the event of such cancellation to award the prize to
an eligible, non-suspect entry received prior to cancellation.
Contestant agrees that entry and acceptance of prize constitutes
permission for Underworld Distributing to have the option of using
the name, hometown, likeness, photograph, voice and statements of
the Contestant. Such use will be without compensation and may be
for editorial, public relations, promotional or advertising
purposes, or any other purpose as deemed reasonable by Underworld
Distributing. Documentation of such permission may be requested by
Underworld Distributing, and failure to provide such documentation
will result in forfeiture of any winner status and/or prize.
This contest is limited to US Residents only, and Contestants must
have a shipping address in the United States. This contest is void
where prohibited by law. Applicable taxes are the responsibility
of the Contestant, and appropriate tax identification information
may be required prior to the awarding of any prize.
Contestants,supporters of the contest, and other such persons will
be afforded the oppurtunity to participate in the contest voting
system. However, Underworld Distributing holds the sole right to
award the prize to any entrant of their choice upon completion of
the contest if deemed necessary.
Employees of Underworld Distributing, and its affiliates, parent
companies and subsidiary companies, and their immediate families
(parents and children) are not eligible to participate in the
contest.
This contest is sponsored and promoted by Underworld Distributing,
the parent company of Rockstar Clothing.
The winning selection will be posted online after the close of the
voting period. Winners will also be notified via email.
Any Contestant who does not agree with the above terms and
conditions should not enter this contest.
RULES AND REQUIREMENTS:
Requirements:
1. Contestent must accept these terms and conditions in order to
enter this contest. If Contestant is under the age of 18, a parent
or legal guardian of the Contestant must accept these terms and
conditions in order to enter the contest.
Entry Rules:
1. Contestants must sell at least 50 tickets prior to October 20th
in order to be eligible to play in the Battle of the Bands.
Tickets can be purchased from Rockstar Clothing sales associates,
Rockstar Clothing's online store, and ticket hot spots around the
Northern Nevada region for $6.00 each. Bands are not limited to
the amount of tickets they can purchase. Any band is eligible to
sell tickets to this event, whether entering or not.
2. First ten bands to sell 50 tickets will automatically earn
their spot in the Battle of the Bands.
3. Every band will be given the oppurtunity to pick their
performance slot in the Battle of the Bands in order of most
tickets sold.
4. Bands who sell 100 tickets will receive $500 dollars worth of
custom band merchandise, regardless if they make it into one the
top ten spots or not. Bands may sell tickets up until the show
date of November 3rd without restriction to amount. Any tickets
not sold may be bought back by Rockstar Clothing if Rockstar
Clothing deems the purchase to be valid.
The Show:
1. Rockstar Clothing's Battle of the Bands 2007 will be held at
The Warehouse located on Highway 50 E. in Carson City, Nevada. The
show will take place on NOvember 3rd, 2007 from 3:00 pm to 11:00
pm. The show will consist of ten bands competing for the grand
prize.
2. Bands will each have 10 minutes of setup time, and 20 minutes
of play time. Bands who exceed their playing time over 15 minutes
will be subject to disqualification.
3. The Warehouse will be providing sound and technical support for
all bands.
4. Bands may be given the oppurtunity to sell band merchandise at
the show under the sole discretion of Rockstar Clothing. Bands
must contact Rockstar clothing by October 27th if they would like
sell mechadise at the show.
5. Bands will be given the oppurtunity to create a digital image
or video to be displayed on the video screen during their
performance and throughout the Battle of the Bands. Any material
displayed will be prescreened for appropriateness. All digital
imagery must be submitted by OCtober 27th.
Voting System:
1. Each valid ticket holder will be able to place one vote for the
band of their choice at any time during the Battle of the Bands.
2. Each vote placed will be counted as one point for that band.
3. Votes will be counted at the end of the tenth band. The winners
will be announced at the conclusion of the show.
Winner's will be awarded their prize as follows:
Grand Prize:
- $250.00 cash.
- Over $350 in Rockstar Apparrel.
- $500 worth of custom printed band merchandise and vinyl decals.
For a total of $1,100 dollars worth in cash and prizes!!!
Second Prize:
- $350 worth of custom printed band merchandise and vinyl decals.
Third Prize:
- $100 worth of custom band decals.
Other prizes may be awarded based on possible sponsor donations.
By entering into the Rockstar Clothing Battle of the Bands 2007,
You Agree To Indemnify Underworld Distributing for Any Claims
Resulting From Your Violation of These Terms and Conditions.
YOU AGREE TO INDEMNIFY AND HOLD Underworld Distributing, ITS
PARENTS, SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, CO-BRANDERS,
LICENSORS AND ANY OTHER PARTNERS AND EMPLOYEES HARMLESS FROM ANY
AND ALL LOSSES, EXPENSES, DAMAGES OR COSTS, INCLUDING REASONABLE
ATTORNEYS’ FEES, RESULTING FROM ANY VIOLATION OF THESE TERMS AND
CONDITIONS.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT UNDERWORLD DISTRIBUTING
WILL HAVE NO LIABILITY FOR SPECIAL, INCIDENTAL, INDIRECT OR
CONSEQUENTIAL DAMAGES OF ANY KIND IN CONNECTION WITH YOUR ENTRY OR
PERFORMANCE IN THE BATTLE OF THE BANDS, EVEN IF YOU HAVE BEEN
ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This Agreement will be governed and construed in accordance with
the laws of the State of Nevada, without regard to its conflict of
laws provisions. By using the contest sites you agree to personal
jurisdiction of the state and federal courts of the State of
Nevada.
You agree that Underworld Distributing reserves the right to amend
these Terms and Conditions at any time, for any reason, and
without notice, including the right to terminate the contest.
These Terms and Conditions are the entire agreement between you
and Underworld Distributing and govern your use of the contest
sites and services. This agreement supersedes any prior agreements
between you and Underworld Distributing. The failure of Underworld
Distributing to enforce any right or provision of this agreement
does not constitute a waiver of the right or provision. If any
portion of this agreement is deemed to be invalid, the other
portions of the agreement will remain in full force and effect.
